Terms of Service & User Agreement

Welcome to CHAMET. These Terms of Service ("Terms") form a legally binding contract between you and FULIAO HONG KONG LIMITED ("CHAMET," "we," or "us"). By using our mobile application ("App"), website, or any part of our Service, you agree to these Terms. If you do not agree, do not use the Services. Please also review our Privacy Policy, which is part of these Terms.

The App and Service are owned and operated by FULIAO HONG KONG LIMITED. By accessing the App or using any part of the Service, you agree to be bound by these terms. Nothing in this Agreement shall be deemed to confer any third-party rights or benefits.

1. Who Can Use the Services

No one under 18 is allowed to create an account or use the Services. By using the Services, you state that: you can form a binding contract with CHAMET; you will comply with these Terms and all applicable local, state, national, and international laws. If you are using the Services on behalf of a business or entity, you state that you are authorized to agree to these Terms on its behalf.

You warrant that you are at least 18 years old. If you are under 18, do not attempt to register or use the App or Service. Use of the Service with or without registering by a minor is only with the approval of a parent or guardian.

2. Rights We Grant You

CHAMET grants you a personal, worldwide, royalty-free, non-assignable, nonexclusive, revocable, and non-sublicensable license to access and use the Services for the sole purpose of using and enjoying the Service's benefits in accordance with these Terms and our usage policies.

Software we provide may automatically download and install upgrades or updates; you may adjust this through your device settings. You may not copy, modify, distribute, sell, or lease any part of our Services, nor reverse engineer or attempt to extract source code, unless permitted by law or you have our written permission.

3. Rights You Grant Us

When you create, upload, post, send, receive, or store content through our Services, you retain ownership but grant CHAMET a worldwide, royalty-free, sublicensable, and transferable license to host, store, use, display, reproduce, modify, adapt, edit, publish, and distribute that content to operate, develop, provide, promote, and improve the Services. For certain crowd-sourced or public Services you may grant broader perpetual rights. We may access, review, screen, and delete your content at any time. You remain responsible for your content.

The Services may contain advertisements. You agree that CHAMET, its affiliates, and third-party partners may place advertising on the Services. We may use feedback or suggestions you volunteer without compensating you. You agree to receive emails or text messages about management and operation of the Services.

4. The Content of Others

Content on our Services produced by users or third parties is the sole responsibility of the person or organization that submitted it. Although CHAMET may review and remove content that violates these Terms, we do not necessarily review all content and cannot take responsibility for content others provide. We do not endorse the truthfulness, accuracy, or reliability of user content. You waive legal or equitable rights or remedies against us in respect of such content and rely on it at your own risk.

5. Privacy

Your privacy matters to us. Please read our Privacy Policy to learn how we handle your information. By using our Services, you agree that CHAMET can collect, use, and transfer your information consistent with that policy.

6. Respecting Other People's Rights

You may not upload, send, or store content that: violates others' rights (publicity, privacy, copyright, trademark); bullies, harasses, or intimidates; defames; spams or solicits users; is illegal, harmful, threatening, abusive, vulgar, offensive, obscene, hateful, or promotes violence or discrimination; introduces viruses or harmful code; attempts unauthorized access; uses scrapers or automated means to access the Services; or involves sexually explicit images or activity harmful to minors. You must also respect CHAMET's rights: do not use our branding, logos, or content except as set forth in these Terms, or use the Services for unauthorized commercial purposes.

We reserve the right to remove or refuse to distribute content and to access, preserve, and disclose information as we reasonably believe necessary to satisfy law, enforce these Terms, address fraud or security issues, or protect rights and safety. We are not liable for the exercise or non-exercise of this right.

7. Respecting Copyright

You agree to only submit content you have the lawful right to use and that does not infringe third-party intellectual property or privacy rights. CHAMET respects the Digital Millennium Copyright Act and will take reasonable steps to remove infringing material. Repeated infringement may result in account termination. To report copyright infringement, contact contact@ichametagency.com with the required information (signature, identification of work and infringing material, contact details, good-faith statement, and accuracy statement under penalty of perjury).

8. Safety

By using the Services you agree not to: use the Services for illegal or prohibited purposes; use robots, scrapers, or automated means to access the Services or extract user information; develop third-party applications that interact with the Services without our written consent; interfere with other users or impair the Services; use another user's account or credentials; post pornography, graphic violence, threats, hate speech, or incitements to violence; upload viruses or malicious code; circumvent content filters or access unauthorized areas; or probe or test vulnerabilities. We may investigate and prosecute violations and cooperate with law enforcement. Do not use the Services in a way that distracts you from traffic or safety laws.

9. Your Account

You are responsible for any activity in your account. Keep your account secure (e.g. use a strong, unique password). You agree not to: create more than one account; create another account if we have disabled yours (unless we give written permission); buy, sell, rent, or lease account access without our permission; share your password; or access the Services through unauthorized third-party applications. If you believe someone has gained access to your account, contact CHAMET Support at contact@ichametagency.com.

10. Purchases and Payments

We may offer in-app or in-service purchases. You buy virtual products (e.g. gems) to use them; you do not own the underlying Services. CHAMET does not handle payments; third-party providers (e.g. Apple App Store, Google Play) do. All purchases are final and non-refundable. By accepting these Terms you agree that CHAMET is not required to provide a refund. We may change, modify, or eliminate virtual products at any time; we have no liability for doing so. If we suspend or terminate your account, you may lose purchased products. If you are under 18 (or under the age of majority where you live), obtain parental consent before purchasing. CHAMET does not transmit funds and is not a money-services business; any such functionality is provided by unaffiliated third parties under their terms.

11. Data Charges and Mobile Phones

You are responsible for any mobile charges (e.g. data, text messaging) incurred from using our Services. Check with your service provider if unsure.

12. Third-Party Services

If you use a service, feature, or functionality operated by a third party and made available through our Services, that party's terms govern your relationship with that party. CHAMET is not responsible or liable for third-party terms or actions.

13. Modifying the Services and Termination

We may add, remove, or change features, products, or functionalities, or suspend or stop the Services, at any time and without prior notice. CHAMET may terminate these Terms with you at any time, for any reason, without advance notice, including by deactivating your account for prolonged inactivity or inappropriate behavior and reclaiming your username.

14. Indemnity

To the extent permitted by law, you agree to indemnify, defend, and hold harmless CHAMET and its directors, officers, employees, and affiliates from and against any complaints, charges, claims, damages, losses, costs, liabilities, and expenses (including attorneys' fees) arising from: (a) your access to or use of the Services; (b) your content; and (c) your breach of these Terms.

15. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. CHAMET DOES NOT WARRANT THAT THE SERVICES WILL ALWAYS BE SECURE, ERROR-FREE, OR TIMELY, OR FUNCTION WITHOUT DELAYS OR IMPERFECTIONS, OR THAT ANY CONTENT OR INFORMATION WILL BE TIMELY OR ACCURATE.

CHAMET ASSUMES NO LIABILITY FOR ANY CONTENT THAT YOU, ANOTHER USER, OR A THIRD PARTY CREATES, UPLOADS, POSTS, SENDS, RECEIVES, OR STORES ON OR THROUGH OUR SERVICES. YOU MAY BE EXPOSED TO CONTENT THAT IS OFFENSIVE, ILLEGAL, MISLEADING, OR INAPPROPRIATE; CHAMET IS NOT RESPONSIBLE FOR IT.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHAMET AND ITS MANAGING MEMBERS, SHAREHOLDERS, EMPLOYEES, AFFILIATES, LICENSORS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR MULTIPLE DAMAGES, OR LOSS OF PROFITS, REVENUES, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM: (A) YOUR ACCESS TO OR USE OF OR INABILITY TO USE THE SERVICES; (B) THE CONDUCT OR CONTENT OF OTHER USERS OR THIRD PARTIES; OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR CONTENT. IN NO EVENT WILL CHAMET'S AGGREGATE LIABILITY EXCEED THE GREATER OF $100 USD OR THE AMOUNT YOU PAID CHAMET, IF ANY, IN THE LAST 12 MONTHS.

Some jurisdictions do not allow the exclusion or limitation of certain damages; some of these limitations may not apply to you.

17. Arbitration

These Terms shall be construed and governed by the laws of Hong Kong. Disputes shall first be settled by amicable negotiation. If negotiation fails, the dispute shall be submitted to the Hong Kong International Arbitration Centre for arbitration in accordance with its rules in force. The venue shall be Hong Kong. The arbitral award shall be final and binding.

18. Choice of Law

Except to the extent preempted by the laws of Hong Kong, the laws of Hong Kong (other than conflict-of-laws principles) govern these Terms and any disputes arising out of or relating to these Terms or their subject matter, including tort claims.

19. Severability

If any provision of these Terms is found unenforceable, that provision shall be severed and the remaining provisions shall remain in full force and effect.

20. Additional Terms for Specific Services

We may have additional terms for specific Services. Those terms, available with the relevant Services, become part of your agreement with us if you use those Services.

21. Final Terms

• These Terms constitute the entire agreement between you and CHAMET and supersede any prior agreements.
• These Terms do not create any third-party beneficiary rights.
• Our failure to enforce a provision is not a waiver.
• We reserve all rights not expressly granted to you.
• You may not transfer your rights or obligations under these Terms without our consent.
• These Terms were written in English; to the extent a translated version conflicts with the English version, the English version controls.
